PRIVACY POLICY

Carr Creations is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include names, addresses, email addresses, phone and facsimile numbers. This Personal Information is obtained in many ways including project questionnaire, correspondence, by telephone and facsimile, by email, via our website, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing. When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information. Sensitive information will be used by us only (1) For the primary purpose for which it was obtained (2) For a secondary purpose that is directly related to the primary purpose (3) With your consent; or where required or authorised by law.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party. We take all necessary precautions in securing your personal and payment information. We do not store any information outside of the payment provider. Disclosure of Personal Information

Your Personal Information may be disclosed in several circumstances including the following: (1) Third parties where you consent to the use or disclosure; and (2) Where required or authorised by law.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing. Carr Creations will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information. In order to protect your Personal Information, we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up to date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Sub-contracting Policy

Carr Creations does not sub-contract any component of work to subcontractors. All work is completed by Carr Creations. Carr Creations consists of husband and wife Melissa and Dean Carr.

Confidentiality

Confidential information (the "Confidential Information") refers to any data or information relating to the business of the Client which would reasonably be considered to be proprietary to the Client including, but not limited to, accounting records, business processes, and client records and that is not generally known in the industry of the Client and where the release of that Confidential Information could reasonably be expected to cause harm to the Client.

Carr Creations agrees that it will not disclose, divulge, reveal, report or use, for any purpose, any Confidential Information which the Contractor has obtained, except as authorized by the Client. This obligation will survive the expiration or termination of this Agreement and will continue indefinitely. All written and oral information and materials disclosed or provided by the Client to the Contractor under this Agreement is Confidential Information regardless of whether it was provided before or after the date of this Agreement or how it was provided to the Contractor.

PAYMENT POLICIES

Carr Creations will provide a copy of the invoice in this contract, the invoice has been formed to accept the instalments as defined in Payment Terms. Work on the project will cease unless the payment terms are adhered to. If at prior to publication instalment, the payment is not made within 30 days, the website will remain unpublished and if after 90 days payment still has not been received or the client is not responding to correspondence the website will be exported and stored until payment has been received in full. Carr Creations will accept instalment/payment plans if Direct Debit is established through GoCardless, please refer to the Direct Debit Policy.

Direct Debit Policy

Carr Creations will accept instalment payments for the project for an agreed instalment rate and agreed schedule. Instalment/Payment plans must be established as a direct debit via GoCardless. This direct debit must be established prior to commencement and payments will commence at the agreed rate for the agreed duration. Two (2) direct debits must be received prior to commencement of the project and continue without interruption or rejection of payment. If any direct debits are declined or rejected, the client will be contacted to make the necessary corrections and if another payment is rejected or declined, the outstanding balance must be paid in full before the project recommences.

If the client chooses to pay for the project by instalments, the website will remain the property of Carr Creations until the project is paid in full. Administrative access as well as logins and passwords will not be provided to the client until the project is paid for in full.

Renewal Policy - Plugins

Applicable licensed plugins will be invoiced on an annual basis and payable by the invoice date. If payment is not made within 30 days, the plugin license will be removed. This will likely impact the functionality of your website, especially in relation to page builder plugins. If the client does not renew the licensed plugin/s, they do this knowing that the website may not operate as expected and any rectification works shall be billed at the hourly rate of $50. If the client chooses not to renew the licensed plugins, please advise Carr Creations upon receipt of the renewal invoice and they will be deactivated.

Renewal Policy – Annual Hosting

Carr Creations hosting will be invoiced on an annual basis at the agreed rate and payable by the invoice date. If the payment is not made within 30 days, the website will be unpublished, exported and stored until payment has been received in full. If the client chooses not to renew the hosting package, Carr Creations will take a website export (.xml file) and provide to the client at a fee of $50. The client is doing this acknowledges that the website may not upload correctly into another platform without the corresponding licensed / unlicensed plugins and theme.

Renewal Policy – Monthly Hosting

Carr Creations hosting can be established on a monthly fee schedule as a direct debit via GoCardless. This direct debit must be established at the prior to publication payments and the direct debit will commence each month at the agreed rate. If monthly direct debits are rejected or payment is declined, the client will be contacted to make the necessary corrections and pay the outstanding amounts owing. If the client chooses not to renew the hosting package, Carr Creations will take a website export (.xml file) and provide the file at a fee of $50. The client is doing this acknowledges that the website may not upload correctly into another platform without the corresponding licensed / unlicensed plugins and themes.

LATE PAYMENTS POLICY

Carr Creations will invoice the client upon completion of the project and will generate a reminder every 7 days until the invoice is paid. If the client does not pay the invoice within the 3 reminders period all services are suspended and all future work must be paid upfront. If after 3 reminders the invoice still remains unpaid, the client will be charged a late fee of $5 per day for each day the invoice is late from the 3rd reminder.

REFUND POLICY

If the client halts work and applies for a refund within 4 days of commencement, work completed shall be billed at the hourly rate of $50 and deducted from the initial payment, the balance of which shall be returned to client.  If, at the time of the request for refund, work has been completed beyond the amount covered by the payments, the client shall be liable to pay for all work completed at the hourly rate stated above within 7 days of invoice date. If any amount owing is not received within 60 days of invoice date, Carr Creations will delete the site contents.

Portfolio Use

Carr Creations retains the right, to reproduce, publish, and display Work including but not limited to the Carr Creations portfolio, websites, marketing materials, publications, and other media or exhibits for the purposes of recognition, promotion, and advertising. Client agrees that when asked, must properly identify Carr Creations as the creator of Work. Client does not have the duty to display Carr Creations name together with Work, but Client may not mislead others that Work was created by anyone other than Carr Creations.

Logins and Passwords Use

Any confidential logins and passwords are securely stored within an encrypted password manager during the build phase of the project and are the sole property of the client. Carr Creations may not use these for any purpose other than that contracted for in this Agreement.
